FastSvelte Terms of Service

Welcome to FastSvelte. These Terms of Service govern your use of our software, services, and website. By purchasing, downloading, or using FastSvelte, you agree to be bound by these terms.

1. Introduction and Acceptance

These terms become effective immediately upon your first use of the FastSvelte software or services. FastSvelte is designed for independent creators, entrepreneurs, developers, and small to medium businesses looking to build SaaS applications with Python and SvelteKit.

2. Software License

FastSvelte grants you a commercial software license based on your purchased package (Solo, Developer, or Team). This license provides perpetual access to the software with the limitations specified in your package tier. The complete license terms are detailed in our License Agreement.

We retain the right to terminate access for violations of these terms or our license agreement.

3. Financial Terms

  • All purchases are one-time payments with no recurring fees.
  • Due to the digital nature of our product, no refunds are provided once the software has been purchased and downloaded.
  • We reserve the right to change pricing at any time, though existing customers will retain access at their original purchase price.
  • Upgrade pricing (90% credit from previous purchases) may be modified or discontinued at our discretion.

4. Permitted Use

You may use FastSvelte to:

  • Build commercial SaaS applications for yourself or clients.
  • Modify and customize the software for your projects.
  • Create and distribute end products using the software.
  • Use the software for learning and educational purposes.

5. Prohibited Conduct

You may not:

  • Resell, redistribute, or sublicense FastSvelte in its original form.
  • Use the Software, in whole or in part, as the basis for a competing starter kit, boilerplate, template, or developer tool product intended for sale or distribution — regardless of the degree of modification. This restriction does not apply to end products (e.g. SaaS applications) built using the Software.
  • Share your license with unauthorized users beyond your package limits.
  • Remove or modify copyright notices in the source code.
  • Use FastSvelte for illegal activities or in violation of third-party rights.
  • Represent yourself as affiliated with or endorsed by FastSvelte.
  • Reverse engineer or attempt to extract our proprietary methods.

6. Warranties and Disclaimers

FastSvelte is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

  • That the software will meet your specific requirements or expectations.
  • That operation will be uninterrupted, timely, secure, or error-free.
  • That all defects or errors will be corrected.
  • Any implied warranties of merchantability or fitness for a particular purpose.
  • Any warranties of non-infringement or title.
  • That the software will be compatible with any third-party software, hardware, or services.
  • That the software is free of viruses, malware, or other harmful components (though we make reasonable efforts to ensure this).

While we provide lifetime updates, we do not guarantee specific features, timelines, compatibility with future technologies, or continued development of the software.

Third-Party Dependencies: FastSvelte incorporates and relies upon third-party open-source software, frameworks, and libraries (including but not limited to FastAPI, SvelteKit, Python, Node.js, PostgreSQL, and various npm/pip packages). We make no warranties regarding these third-party components and are not responsible for any issues, vulnerabilities, breaking changes, or damages arising from their use, updates, or discontinuation. You acknowledge that third-party dependencies are governed by their own respective licenses and terms.

7. Support and Services

Support is provided based on your purchased plan tier and is subject to the following terms:

  • Solo Plan: Documentation and community support only. No direct email support is included.
  • Developer Plan: 30 days of email support for technical questions from date of purchase.
  • Team Plan: 30 days of priority email support for technical questions from date of purchase, with priority handling for faster response times.

Email support covers technical issues including setup, deployment, and integration questions. Support does not include custom feature development, debugging of your application code, or ongoing maintenance beyond the specified support period.

Support is provided during business hours with no guaranteed response time. We will make reasonable efforts to respond promptly, with Team plan customers receiving priority handling. Support is provided in English only.

8. Limitation of Liability

To the maximum extent permitted by applicable law, and regardless of the form of action (whether in contract, tort, negligence, strict liability, or otherwise):

  • Our total cumulative liability for any and all claims arising out of or related to these terms, the software, or your use thereof shall not exceed the amount you actually paid for FastSvelte in the twelve (12) months preceding the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses.
  • We are not responsible for data loss, security breaches, business interruption, lost profits, lost revenue, loss of anticipated savings, or failure to realize expected benefits.
  • We are not responsible for any damages arising from your deployment, hosting, configuration, or security practices.
  • We are not responsible for any damages arising from modifications you make to the software.
  • We are not responsible for any damages arising from the actions of your end users or customers.
  • Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You acknowledge and agree that the limitations of liability set forth herein are fundamental elements of the basis of the bargain between you and FastSvelte, and that FastSvelte would not provide the software without such limitations.

9. Indemnification

You agree to indemnify, defend, and hold harmless FastSvelte, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorney's fees) arising from:

  • Your use of the software or any products or services derived from it.
  • Your violation of these terms or any applicable law or regulation.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any claim that your end product caused damage to a third party or infringed their rights.
  • Any security vulnerabilities, data breaches, or privacy violations in applications you build using the software.
  • Any content you create, transmit, or display using the software.

This indemnification obligation will survive the termination of these terms and your use of the software.

10. Assumption of Risk

You expressly acknowledge and agree that:

  • Your use of FastSvelte is entirely at your own risk. You are solely responsible for any damage to your computer systems, loss of data, or other harm that results from your use of the software.
  • You are solely responsible for the security, compliance, and proper functioning of any applications, websites, or services you build using the software.
  • You are responsible for ensuring your use of the software complies with all applicable laws, regulations, and industry standards (including but not limited to GDPR, CCPA, PCI-DSS, HIPAA, or other data protection and privacy requirements).
  • FastSvelte is a development tool and starter kit. The security, reliability, and compliance of your final product depends on your implementation, configuration, deployment practices, and ongoing maintenance.
  • You have the technical expertise necessary to use the software or have access to qualified professionals who can assist you.

11. Relationship and Representation

No employment, partnership, joint venture, or agency relationship is created between you and FastSvelte through these terms or use of our software. You may not represent yourself as our partner, agent, or affiliate without explicit written permission.

12. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these terms or your use of FastSvelte shall be brought exclusively in the courts located in Ontario, Canada, and you hereby consent to the personal jurisdiction of such courts.

Informal Resolution: Before filing any formal legal claim, you agree to first contact us at support@fastsvelte.dev and attempt to resolve the dispute informally for at least thirty (30) days.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against FastSvelte.

13. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

14. Force Majeure

FastSvelte shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, strikes, power outages, internet service provider failures, or failures of third-party services or infrastructure.

15. Entire Agreement

These Terms of Service, together with our License Agreement and Privacy Policy, constitute the entire agreement between you and FastSvelte regarding your use of the software and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written. No modification, amendment, or waiver of any provision of these terms shall be effective unless in writing and signed by FastSvelte.

16. No Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these terms will be effective only if in writing and signed by FastSvelte.

17. Changes to Terms

We reserve the right to modify these terms at any time at our sole discretion.

For new purchases: Updated terms apply immediately upon posting to our website.

For existing customers: We will notify you of material changes via email. Updated terms take effect thirty (30) days after notification. If you do not agree to the updated terms, you may continue using your existing license under the terms in effect at the time of your purchase. However, updated terms will apply to any future purchases, support requests, or access to new software updates released after the effective date.
